Your employee, Jessica Jones, has been approved to take a medically necessary hourly rest break of approximately 10 minutes for her Family and Medical Leave Act (FMLA)-covered chronic health condition. Which of the following is accurate?
A) Because the breaks are less than 20 minutes, the time must be paid under the requirements of the Fair Labor Standards Act (FLSA).
B) Because the breaks are intermittent leave under the FMLA, the time need not be paid, though the employee may concurrently use paid time off or other paid leave to cover the hours missed.
C) Employees are not permitted to use intermittent leave for less than 1 hour at a time.
